Circuit Court
In the name of God amen. I Hugh Murphy of Hardy County and the state
of Virginia being in a pore state of health but of sound and disposing
mind memory and undertanding considering the certainty of death and the
uncertainty of the time:
thereof do therefore make and publish this my last will, and. Testament
in manner following that is to say: First and principally I commit my soul
into the hand of Almighty God and my Body to the Earth to be decently buried
at the discretion; of my Executors herein after named and after my Debts
and funeral charges are paid I do devise and bequeath as follows.
Item I give and bequeath unto John Hindman one hundred acree of land to be laid of to him out of the aforesaid tract of joining John Johnson to him the said John Hindman his heirs and asigns in fee simple.
Item I give bequeath unto William Shillingburg one hundred acres of land to be laid of to him out of the aforesaid tract to include the place where he the said Shillingburg has been grubbing to him his heirs in fee simple.
Item I give and bequeath unto my natural daughter known by the name of Polly Murphy born of the aforesaid Elenor Malone one hundred acres of land to be laid off to her out of the aforesaid tract to her the said Polly Murphy and her heirs in fee simple.
Item I give and bequeath unto the said Polly Murphy one cow and two sows to her and her heirs forever.
Item I give and bequeath unto my natural son known by the name of Hugh Murphy own brother to the said Polly Murphy the tract of land where I now live known by the name of Me Lords Madows being two hundred and forty nine acres to him the said Hugh Murphy his heirs and asigns in fee simple.
Item I give and bequeath unto the said Hugh Murphy all the rest and remainder my lands except the lands which I have willed to Elenor Malone John Hindman, William Shillingburgh and Polley Murphy to him the said Hugh Murphy his heirs and his asigns in fee simple.
Item I give and bequeath unto the said Hugh Murphy all my personal estate to him and his heirs forever. It is my will and desire that the lands bequeathed to Elinor Malone, John Hindman, William Shillingburgh, Polley Murphey be laid of equal value to each by disinterested men appointed for that purpose and lastley testament. In testimony whereof I have hereunto set my hand and affixed by this twenty eight day of October Anno Domino one thousand seven hundred and ninety seven.

At a superior court continued and held for the District composed of
the Counties of Hampshire, Hardy and Pendleton at the courthouse in the
said County of Hardy the 8th day of May 1801. This last will and testament
of Hugh Murphy deceased was this day proved by the oath of Lewis Vandiver
one of the witnesses thereto at a Court continued hold for the said District
the 7th day September then next following said will was further proved
by the oath of John Nixon another witness thereto and is ordered to be
recorded.
